What is the difference between a hotel, hostel, Airbnb and short-term rental?
Although these terms are used interchangeably in everyday conversation, for legal and tax purposes they carry distinctions that matter. The INGUAT regulations group them all within the "lodging establishments" category, but with subcategories that affect registration fees, sanitary requirements and tax classification.
The line between "lease" and "lodging" is the one that most often generates confusion with Airbnb. Habituality, profit purpose and short duration convert the rental into a lodging service, with all the obligations of the sector. Renting your house once a year to a relative is a lease; listing it on Airbnb with continuous bookings and a per-night price is lodging.
The 8 essential permits and licenses
1. Incorporation of the operating company and NIT
A Corporation (S.A.) or Limited Liability Company (S. de R.L.) registered at the Commercial Registry, business license, and NIT (tax ID) with SAT under the economic activity "lodging services." Choice of tax regime: general, small taxpayer or profits.
2. MSPAS sanitary license
Filed with the Ministry of Public Health. Verifies drinking water, sewer, kitchen (if any), rooms, pest control and waste management conditions. Annual renewal.
3. Municipal operating license
With compatible land use under the municipal POT (Territorial Ordering Plan). Requires an IUSI (single property tax) clearance and boleto de ornato (annual municipal tax). Typically renewed annually.
4. Fire Department license
Inspection of evacuation routes, fire extinguishers, signage, smoke detectors and maximum capacity. Certificate with annual validity.
5. INGUAT registration
Under Decree 1701 and its regulations, every lodging establishment must register with the Guatemalan Institute of Tourism and obtain its registration number and category.
6. Environmental instrument before MARN
Under Decree 68-86 and its regulations. Category C is typical for small lodgings; B1 or B2 for medium and large hotels or those in environmentally sensitive areas.
7. Internal rules and guest register
Document with rates, check-in/out policies, cancellations and liability; guest register with identification, nationality, dates and purpose of travel.
8. Anti-Trafficking Law protocol (Decree 9-2009)
Staff training, procedures for unaccompanied minors, visible signage and reporting channels. Failure to observe carries joint criminal liability.
Mandatory INGUAT registration
Decree 1701, the Organic Law of the Guatemalan Institute of Tourism, and its regulations, created a specific regime for lodging establishments. Every operator — from a large hotel chain to an Airbnb run by an individual — must be registered in INGUAT's register of lodging establishments.
This registration is more than administrative: it is the trigger that activates the obligation to collect and remit the Hotel Tax. It also determines the category (stars, under the hotel classification regulations) that may be shown to the public. Displaying unauthorized categories is sanctionable.
The typical INGUAT filing includes:
- Formal application with details of the establishment and the owner/operator.
- Registry certification of the property and the lease agreement if applicable.
- Business license and current RTU (Unified Tax Registry).
- Current MSPAS sanitary license.
- Municipal operating license.
- Current Fire Department license.
- Floor plans of the establishment with room layout and common areas.
- Internal rules of the establishment and proposed rates.
- Payment of INGUAT fees.
Hotel Tax and tax regime
Art. 25 of Decree 1701 created the Hotel Tax, equivalent to 10% on the value of lodging. It is a tax that the hotel passes on to the guest — it appears on the invoice — and that the operator remits to INGUAT within the regulatory deadlines. This tax is added on top of the 12% VAT and applies to the room, not to complementary services such as restaurant or laundry if they are itemized separately.

The choice of tax regime has a direct impact on the profitability of the lodging business and must be made before starting operations. A poorly chosen regime can reduce operating margin by 5 to 15 percentage points.
Human trafficking prevention: a critical sector obligation
One of the topics most underestimated by new operators — and one of the largest sources of penalties — is compliance with Decree 9-2009, the Law Against Sexual Violence, Exploitation and Human Trafficking. This law imposes specific obligations on lodging establishments whose breach generates criminal, not just administrative, liability.
Specific obligations include:
- Guest register with verified identification (DPI or passport) and available for inspection.
- Verification of accompanied minors: when a minor stays with an adult who is not their legal representative, there must be written authorization from a parent or guardian.
- Staff training to detect indicators of trafficking: minors with no luggage, unusual relationships between an adult and a minor, cash-only payments with intermittent stays, use of the room by unregistered third parties.
- Visible signage with reporting information (hotline 1546 and other official channels).
- Reporting protocol — immediate notification to PNC and the Public Prosecutor's Office in any suspected case.
- No cover-ups: receiving money "not to report" constitutes criminal complicity.
Important for Airbnb operators: many hosts assume that "because I don't have a receptionist" the obligation does not apply. That is a mistake. The law applies to every lodging establishment. The owner/operator is directly liable if the property is found to have been used for trafficking, even if they were not physically present.
Airbnb in a residential zone: what almost no one knows
It is the most frequent conversation in our office: "I bought an apartment in zone 14 and I want to list it on Airbnb — can I?" The answer is usually nuanced, and depends on three regulatory layers that must be reviewed before investing:
Land use under the municipal POT
Exclusively residential zones typically prohibit commercial use, including lodging. Mixed or permitted-commerce zones allow it. Without compatible land use, a municipal license is impossible.
Horizontal property / condominium rules
If the property is in a condominium or apartment building, the internal rules often prohibit rentals shorter than 30 or 90 days. The owners' assembly can sue and obtain a court order to stop the activity.
Specific restrictions in tourist zones
Antigua Guatemala, for example, has additional restrictions due to its World Heritage status and the regulations of the CNPAG (National Council for the Protection of Antigua Guatemala).
Reviewing these three layers before buying or adapting a property for Airbnb usually saves tens of thousands of quetzales in modifications, fines and — in the worst case — the total impossibility of operating the business at that location.
Guest contracts and operator protection
The other frequently neglected front is the contractual relationship with the guest. A platform booking is not enough as legal backup. A prudent operator should have in place:
- Visible internal rules at check-in, with rates, hours, cancellation policies, liability for damages and prohibitions.
- Guest registration form with data, signature and acceptance of the rules.
- Security deposit for damages, with clear conditions for withholding and refund.
- Civil liability policy for the establishment — protects against injuries, thefts and incidents inside the property.
- Personal data processing consent (Public Information Access Law and data protection best practices).
- Written protocol for medical emergencies, fires or third-party complaints.
Without this framework, a relatively minor incident — a guest injured on the stairs, a theft inside a room, a neighbor complaint — can escalate into a lawsuit that consumes an entire year's operating margin.

Can I operate an Airbnb as an individual without forming a company?
Yes, provided you register with SAT as an individual with lodging economic activity. However, for asset protection it is more advisable to operate under a company, especially because of civil liability toward guests and issues under the Law Against Human Trafficking.
Is the Hotel Tax charged on the total or only on the room?
On the value of the lodging (room). Complementary services such as restaurant, laundry or tours invoiced separately do not carry the Hotel Tax, but they do carry VAT.
How long does the full license package take?
With an organized file and the physical adjustments already made, the full package (MSPAS, Fire Department, municipal, INGUAT, MARN) typically takes between 60 and 120 business days. Starting operations before completing the package exposes you to closure.
What happens if a guest is injured at my establishment?
Without a current sanitary license, without a Fire Department license and without an insurance policy, civil liability falls entirely on the operator. With all three, the insurer responds and a legal defense is viable. It is the best argument not to skimp on compliance.
Does Airbnb report my income to SAT?
Guatemala has advanced information-exchange agreements. It is prudent to assume that SAT can access information from international platforms and issue preventive assessments. Operating informally is a growing tax risk.
